Though many of us suffer from Palin Factor Fatigue, it is irrefutable that there is a nagging curiosity to have the question answered, ?How in the world did Sarah Palin become so popular and why do we still need to hear about her?? "Blue Oasis" began in 2005 in its Blogger format (now an archive) and became possibly the first Alaska Blog on Progressive Politics. At the 2008 Democratic National Convention, Celtic Diva's Blue Oasis was honored to represent Alaska as the state blog.

YOUR BLOGMISTRESS

My name is Linda Kellen Biegel and I am a former 15-year Federal employee. Thirteen of those years were spent working for the US Army Corps of Engineers. I am also semi-retired from the Alaska music scene (singer, sound tech, stage manager, logistics).

When the blog was chosen to represent Alaska in the DNCC State Blogger Pool at the Denver Convention, I attended with the help of Alaska Real blogmistress, Writing Raven and my daughter Morrigan. On August 29th, one day after Barack Obama's inspiring speech at Invesco Field , my life took another turn as it did for all Alaska bloggers when Gov. Sarah Palin was chosen to be John McCain's VP running mate. Since then, I've either assisted or have been interviewed by media from the UK, Italy, Australia and Germany as well as national media outlets such as Wall Street Journal, NY Times, ABC Good Morning America's Kate Snow, National Journal, Dallas Morning News, LA Times, and NPR.

Presently, I work as a freelance writer, PR, event coordinator, community organizer, wife to computer programmer Josh and mother to 11-year-old Morrigan. Our family especially enjoys our summers in Alaska where we get to subsistence set-net fish Sockeye salmon as well as halibut fish/whalewatch in the family's homemade aluminum boat, "The Neverdone" (when it's working). We reside in Anchorage, Alaska.

I've used "Celtic Diva" as a screen name since the early 1990's on Web TV.

"Folks have asked about my Celtic heritage, especially in light of my name. What they don't realize is that I'm adopted. I was born Valerie Morehead of the Clan Muirhead. I was adopted at three-months-old by the Kellens. I always "knew" I was Celt even before really knew. I was drawn to all things Scottish, especially music. That's why my parents eventually told me at age 16."

September meetings will decide Palin's legal fate--Personnel Board Pt. 1 **UPDATE**

The next meeting of the Alaska Personnel Board is coming up on September 9, 2009.  If anyone remembers the last Personnel Board meeting, we saw how unprofessionally Board President Debra English acted not only towards the general public but the media as well.  

This one should be even more interesting for several reasons:

1)  There are a couple of newer, open ethics complaints out there with serious teeth.  One (Zane Henning) is in regards to the per diem Sarah Palin charged the State of Alaska to live in her own home.  Another (Andree McLeod) is in regards to the gifts Palin has received that have gone unreported.

2) (The main subject of this post) We have heard NOTHING regarding Kim Chatman's complaint over the Alaska Fund Trust since a report unfavorable to Palin from Investigator Tom Daniel was revealed.  (Of course, it barely covered an iota of the violations revealed by other lawyers in the Fund Trust).  While a number of Palinbots claim that there was no violation here, the report very clearly stated that Palin would be in violation of the Ethics Act if she did not accept his remedy.

3)  I was notified through certified letter that the Personnel Board would be dealing with my comments in reponse to the Arctic Cat dismissal and I would have a chance to speak in Executive session. (To be covered in Part II)

An article by AP this weekend made it obvious that there is still much interest in the results of unresolved ethics complaints against Sarah Palin:

Palin resigned as Alaska's governor abruptly in July, and an independent investigator said he found probable cause she had violated ethics laws by trading on her position as she sought money for legal fees.

We are waiting to find out exactly what is going on with Palin and her AK Fund Trust since Investigator Tom Daniel's report was revealed offering a "remedy" to keep Governor Palin from facing a hearing.  The report was revealed by an unknown source and reported by Alaska AP apparantly a week after Palin and her legal team received it as well as the attached request from the Investigator.  The request was for Palin or her representative to either accept or reject the remedy...a response that Alaska Executive Branch Ethics law requires.

The remedy required that Palin:

...the governor should refuse to accept payment of her legal fees and costs from the Alaska Fund Trust and withdraw her authorization for the trust to be recognized as her "official" legal defense fund...

As of today, she is still taking donations on the AK Fund Trust Website which still declares itself the "the official website for the Governor Sarah Palin legal defense fund."

It's safe to say she never accepted the remedy.

According to the Executive Branch Ethics Act, their ONLY response to rejecting a remedy should have been to:

"...initiate formal proceedings by serving a copy of an accusation upon the subject of the accusation. The accusation shall specifically set out the alleged violation."

We haven't heard when this document was sent out--it should have been sent weeks ago and the twenty-day allowance for Palin's response to the "formal accusation" should be over by now.  However, as soon as that formal document is served to Palin, long before her response is due, according to the EBEA:  "...the accusation is a public document open to inspection."

(In other words, we should have heard by now that the document was sent.  Today, I am sending off an email to the State asking for a copy.)

Giving Daniel and the Personnel Board the benefit of the doubt that they obeyed the law, we'll assume the formal accusation was sent and we have passed the 20-day response period. That means one of three things:

1) They admitted the violation, which would mean that we are now heading into the penalty phase;

2) They denied the charges, which means we should soon see preparations for a hearing;

3) They refused to respond, which is treated as if they admitted fault and the Personnel Board must then assign a penalty.

I have a call into Nicki Neal, Director for State of Alaska Personnel, asking for more information on a future hearing for former-Gov. Palin.

************************************************UPDATE********************************************

According to Ms. Neal, she cannot speak about the AK Fund Trust ethics case because CONFIDENTIALITY STILL APPLIES.

That can mean one of two things

1) They have served Palin with the formal accusation but are refusing to talk about the complaint case even though the Executive Branch Ethics Act (EBEA) states that it should now be public information, or...

2) NO ONE is following the Ethics Act in ANY way and Palin has NOT been served her formal accusation document.

September 9th gets curiouser and curiouser...

I am wondering who is giving Palin a free pass if the three things on your list have not occurred.  Keep holding her feet to the fire.  It couldn't happen to a more deserving person.  This may explain why she has has been out of contact recently.  Whatever the reason for her absence, it's good not to read/hear anymore of her non-sense.

Does anyone want to bet that the Personnel Board has done nothing about this situation with the Legal Fund, and there will be no action taken.  They will find a way to give her a pass just as they have always done.  I hold out no hope that they will follow the law or that they will actually hold her accountable for her actions as we have seen their refusal to act upon anything else.

As for the other two complaints, this is what I am betting on/expecting to see: the per diem will be said to be allowed because the laws are too vague and that she is within her rights to claim that money, and they will claim although late Palin did comply with the request to supply the information regarding the gifts, and they will end up accepting whatever low ball dollar figure that Palin happens to throw out regarding the Arctic Cat Contract.

The Alaskan legislature failed Alaskans (and the rest of the country as it turns out) miserably, when it comes to Sarah Palin.

The Branchflower report found Palin "abused her power by violating section 39.52.110 (a)".

What other state in the union, has had it's legislature find their Governor guilty of abuse power, then fail to impeach or at the very least sanction them?

The report also found that "the Attorney General's office has failed to comply with my August 6th 2008 request to governor Sarah Palin for information about the case in the form of e-mails".

Was that request ever complied with? Did the Alaskan legislature ever follow through on that?

Representitive Les Gara has said that "there was no political will" too take any action against Palin after this lengthy, costly investigation, resulting in the Branchflower Report.

In other words , we found Palin guilty, but simply can't be bothered to do anything about it.

Why hold with the investigation in the first place?

You needn't look any further than the Alaskan legislature, for giving Sarah Palin a free pass to carry on as she pleased.

This personnel board is less willing than the legislature to do their job.

And why not?

If the legislature cannot be bothered, why should they?

If it were not for the progressive bloggers and the conscientious citizens that filed ethics complaints, Palin would continue to be governor with an 80% approval rating.

It is time for Alaskans to clean house in the legislature.

It is HIGH time Alaskans had legislators that have the "political will" to do their job!

There is nothing in your statement that I disagree with, yet from all that I have seen over the last few years, there is no point in holding out hope that anything will change for the better.  I shouldn't say that because there is always hope, but it boggles my mind that this is not only allowed to happen, but seemingly encouraged to happen by the lack of will of the majority of Alaskans willing to stand up and say "NO MORE".  

Thank Heavens for people like Celtic Diva who are not only willing to allow us to see what is going on, but who are willing to work to change the system and hold officials accountable, but sadly it seems like she in in the minority.  

The problem I see is that the people of the State of Alaska have to want the Legislature and the Personnel Board to actually do their jobs and follow through on these problems, which it seems like the majority don't really care one way or another.  If the members of the Legislature and Personnel Board felt like there would be a resounding backlash from their failure to act, they would indeed do something, but because they don't seem to worry about their jobs, or what their constituents think, it seems to me that they are simply following the lead of the people which is to not care enough to do anything about it.

With the help of Tenacious Celtic D., other progressive bloggers, conscientious journalists, citizens and a few good politicians (I'm so rooting for Bob Poe) maybe Alaskans will have there eyes opened.

Maybe they will realize that they do not have to tolerate the massive, ingrained corruption that seems to grip Alaskan politics.

The more national attention the corruption of Alaskan receives the faster it will end.

I look at it like a cancer, with Alaska's case at stage 4.

So far it has been "the feds" with numerous indictments.

Alaskans need to realize that "the feds" and folks from "outside" are not their enemy.

The real enemy in Alaska are the corrupt politicians and careless politicians.

The first are motivated by greed and the second just go with the flow, have no "political will".

Like you, I hope Alaskans will care enough to truly care for themselves.

1.How could they have dismissed your case without knowing the value of the  Artic Cat deal that Todd signed?
Todd had to have known when he signed the contract that it was in violation of the state law when he signed a contract that had no monetary value attached.
Did she ever declared the outfit she was wearing? If you look up the clothing between the boots, pants and jacket, I believe that is over the $250.00 limit.

It is important for our country that palin be held accountable for the actions she took as Gov.
If she ever does go for public office again, she will feel free to do whatever she wants to if not held accountable now.
I think we have seen this throughout the history of our country from Nixon on, republicans have done what they wanted to do, because NO ONE HELD THEM ACCOUNTABLE.
For Alaskan's sake I hope they do not drop this.
palin campaigned as a reformer and was so troubled by ethics problems that she quit her previous job.
It would be hypocritical if she was not held to the same standards that she herself campaigned for.

If the Board does nothing about the ATF situation, can it be reported to the IRS? If it is illegal, does it become a federal issue since money has crossed state lines?

Celtic Diva is the bard of her times.  In ancient celtic lore the story is told of terrible times when the Normans invaded Ireland.  The Normans learned quickly that the Bards, rovers who carried news from tribe to tribe, were the keepers of all tradition.  The Bards could recite the lineages of each tribe, and they took very seriously their duty to maintain the truth of their messages.  Bards who changed the content of their messages were shunned, and stripped of their privileges, which consisted of free room and board, safe passage from territory to territory, and access to clan meetings.  The Bards were respected for their ability to repeat word for word the instructions of clan leaders.  They delivered news of births and war edicts.  

The Normans, seeking to break the backs of the tribe of Emerald Isles, set about finding and slaughtering the Bards in an effort to disrupt the stream of information between the clans.  All conquerers of nations seek to revise history to suit their agendas.  The clans responded by protecting the Bards, and sometimes disguised themselves as Bards to act as decoys.  To honor the Bards, each member of the clan passed on the information to another member of the clan as accurately as possible.  If the Bard was struck down, the information did not die with him.  The clans held the Bards in the highest regard.  The Bards did much to keep the clans strong, but in the end, it was not the Bards who fought the battles.  The people of the clans fought.  

Our bloggers are the modern day Bards.  We, the readers, are the clans who depend on the truth they deliver to us.  Not all bloggers are true to the creed of truth before self, but those who are, we hold in high esteem.  In the end however, our bloggers can but deliver the truth.  We must take action, and heed the call to arms.  

This fight on the steps of the capital is our fight.  If we deem the actions of elected officials to be intolerable to us, we must tell them so, and take actions to see that they do not blemish their elected office further.  This process of change does not come easily.  The vote that changes the balance of power is but the last step in our efforts.  As did the clans of yore, we must pass on what we learn to others.  We must be steadfast in our determination to protect truth.  

Whatever happens with the handling of these ethics complaints, we must be willing to act upon the knowledge gained from the outcome.  If the outcome is unfavorable, we must take the time to ask ourselves why.  We must seek to amend the flaws in our system that allow for such abuses of power to exist.  We must urge our elected officials to press for change, and if they do not, we must be willing to seek those who do.

Alaska was born but a heartbeat ago.  Our system has not been vetted to the extent that other states have had their rules and regulations tested.  We, like all states before us, have to place burdens on our government before we can truly identify the flaws.  What we experience today isn't disaster.  We are growing and learning.  Our only chance for failure is if we stop believing in the process.  Every day of our lives, no matter our wealth or our station, provides an opportunity to participate.  Each generation contributes, and each generation overcomes new challenges.  This is the beauty of it.  The endgame will always be death, but, oh, what passion lies in the middle!
