My name is Linda Kellen Biegel and I am a former 15-year Federal employee. Thirteen of those years were spent working for the US Army Corps of Engineers. I am also semi-retired from the Alaska music scene (singer, sound tech, stage manager, logistics).

When the blog was chosen to represent Alaska in the DNCC State Blogger Pool at the Denver Convention, I attended with the help of Alaska Real blogmistress, Writing Raven and my daughter Morrigan. On August 29th, one day after Barack Obama's inspiring speech at Invesco Field , my life took another turn as it did for all Alaska bloggers when Gov. Sarah Palin was chosen to be John McCain's VP running mate. Since then, I've either assisted or have been interviewed by media from the UK, Italy, Australia and Germany as well as national media outlets such as Wall Street Journal, NY Times, ABC Good Morning America's Kate Snow, National Journal, Dallas Morning News, LA Times, and NPR.

Presently, I work as a freelance writer, PR, event coordinator, community organizer, wife to computer programmer Josh and mother to 11-year-old Morrigan. Our family especially enjoys our summers in Alaska where we get to subsistence set-net fish Sockeye salmon as well as halibut fish/whalewatch in the family's homemade aluminum boat, "The Neverdone" (when it's working). We reside in Anchorage, Alaska.

"AK Fund Trust Iceberg dead ahead!" Can I say "I told you so" now?**UPDATE**

I bring you back to July 3rd, when this fantasy story was told about a Governor who was driven out by us evil filers of "frivolous" ethics complaints...of how she was so abused and was drowning under this huge debt (in spite of the reportedly millions she's getting for her book deal).

Back then, I "puzzled until my puzzler was sore" over what possibly could have motivated Palin to do this.  However, it was my husband that came up with the most logical reason as to why Palin would resign with so much time left in her term:

Hypothetically, what if all of the ethics complaints really ARE over...and several days ago, PALIN WAS TOLD THAT AS GOVERNOR, RECEIVING MONEY FROM THE LEGAL DEFENSE FUND WAS DECLARED UNETHICAL?  One of the options to resolve a potential violation in the Executive Branch Ethics Act is to achieve resolution between the investigator and the complainee.  What if, the only way to a) keep the money or NOT HAVE TO PAY IT BACK and b) to keep her "perfect record" of "no wrongdoing" was to leave the Governor's office?  

At that time, everyone got involved with the Federal Indictment theory--after all, the Executive Branch Ethics Law is terribly misunderstood thanks to the Palin/Van Flein spin.  It's also not very "sexy."

As it turns out, like Al Capone's tax evasion (also not very sexy), Palin's problems involve money problems as well..

An investigator for the state Personnel Board says in his July 14 report that there is probable cause to believe Palin used or attempted to use her official position for personal gain because she authorized the creation of the trust as the "official" legal defense fund.

The practical effect of the ruling on Palin will be more financial than anything else. The report recommends that Palin refuse to accept payment from the defense fund, and that the complaint be resolved without a formal hearing before the Alaska Personnel Board.

Palin's response...on Twitter (of course)...was unethical (she lied), as covered by AP:

Palin posted an entry on Twitter in which she said the "matter is still pending."

"There is no final report. The Investigator is still confidentially reviewing this matter. It appears suspect that in the final days of the Governor's term, someone would again violate the law and announce a supposed conclusion before it is reached," her spokeswoman, Meghan Stapleton, said in an e-mail to The Associated Press.

But Daniel said his report was final.

So, Governor Palin knew AT LEAST by July 14th that this final decision had been reached by the Personnel Board.  (Knowing the process, I strongly suspect that someone tipped her off early...like maybe July 1st or 2nd?)  Palin CONTINUED to collect donations through the site, Palin's supporters have continued to promote the site and amazingly enough, THE SITE IS STILL UP AND STILL TAKING DONATIONS!

She is absolutely disgusting.  If this doesn't wake a few people up, I don't know WHAT will!

And yes...I can't help it...I TOLD YA SO!

In response to rampant speculation (brought on by Palin lies/spin):

1)  Once a report is sent out to the complainant, the findings have already been approved by the Personnel Board.

2)  In this case, it looks like they were just waiting for Palin to agree to the remedy so they could close the case and move on, as well as for her to determine whether or not to waive confidentiality.

3)  For Palin to let it to sit there for a week like that is unheard of. It makes one think that perhaps they had no intention of paying the money back nor of informing the folks who gave them the money.  Of course, that's speculation...

Have you read the little blurb in Newsweek? There was something there that I thought was very strange and interesting.

http://www.newsweek.com/id/207398  That is the link I am talking about.. and here is the money quote I am speaking of.. It really struck me as odd.. See if you pick up on what I am seeing or if I am crazy.

But is that really the reason? John Coale, a Washington lawyer who helped Palin set up a legal-defense fund and PAC, tells NEWSWEEK the fund is "well on its way" to paying off $500,000 in legal debt from the campaign and another $100,000 in bills incurred later, leaving questions about how big a part money woes played in her decision to resign.

That's all I am going to say... see what you think.. I will check back with you later. This may be why she is trying to get that money out of the ADF... she needs that money to pay off these debts. Another part of this blurb said this:

Palin is fuming at the McCain camp, which she believes saddled her with all that debt. At the time John McCain tapped Palin, she was using Alaska state funds to pay the lawyer she hired to defend her against ethics charges. McCain aides, worried that that could raise ethical questions, put an end to the payments. Here's where things get testy: Coale says the McCain campaign, and later the Republican National Committee, led Palin to believe that they would pay her bills, but never did, causing Palin's debt to pile up. But two former senior McCain officials, who asked for anonymity to keep political peace, say there was no such promise (online finance records show no payments to Palin's lawyer). Palin's spokeswoman, her lawyer, and an RNC spokeswoman didn't respond to requests for comment.

Something new? I don't remember hearing this story before.. and so far no one at Mudflats hasn't either.. but the first part was what got my attention first.

In her resignation speech, Palin said "Political operatives descended on Alaska last August, digging for dirt. The ethics law I championed became their weapon of choice." We've hear this said often in past months, always implying these were Democratic operatives- but they were Republicans! They advised Sarah to lay the complaint against herself that is responsible for most of the legal debt.

 Liberty Legal Institute (Dobson's legal eagles) represented six Alaska legislators in a lawsuit to halt the "Troopergate" investigation.

This after a unanimous bipartisan vote to investigate Palin on the Troopergate issue.

They lost the case, and it cost LLI about $185,000.00 for this, plus if I recall correctly the legislative members involved had to claim this dollar figure as a gift (so they wound up paying taxes on this amount).

Well, I don't claim to have the best memory...lol I just knew it had something to do with Troopergate, Palin and McCain was involved somewhere and it had something to do with Dobson, and  Liberty Legal. So I had all the players...just not in the correct order...lol

Thanks for clearing up my faulty memory.. I am still confused how the $500,000 is all due to the campaign, and the rest is after...I know she is claiming Troopergate was expensive for her..but that was her own making...tough cookie lady...sorry but I have no sympathy for her as I know most of you don't either.

Nor, do I understand why she would think McCain should or would pay everything for her.

Now that she has quit as of next week, will she be able to keep all the money in those funds (both the PAC and the Trust)? Since the site has not been taken down, I am assuming that she STILL is collecting moneys on it. Who is over-seeing the disposition of the funds???

Once she is completely out of office, will she be able to set up a DIFFERENT fund, again for her own benefits, but with no oversight? She would still be getting money based on the fact that she was a governor, so she would still be getting it as an illegal enrichment because of her fame, right? (I think it is different in different states, but seems in Alaska, that would be the law, correct?

It helps a lot to understand the complaint process from first-hand experience.

There would have to be accountability for Palin to agree to the remedies.  Do we expect she would be willing to waive attorney-client privilege and actually turn over the attorney bills?

The attorney-client privilege does NOT apply to the amount of an attorney's fees. That is a phony claim made by Palin's sleazy attorney, so he does not have to divulge his fees and Palin can keep claiming she owes 500 or 600 thousand dollars, but never provides any proof. That claim is a lie and is not based on any law anywhere.

So, there is no need for Palin to waive any privilege. Palin's attorney has no legitimate reason not to disclose his billing records. Period.

The word you are looking at "imposed" does actually belong in the paragraph on the preceding page.

The last sentence in that paragraph says...

What is below that is marked by a "1" in front of the paragraph and is an footnote explanation from Page 8, the second paragraph down on the page.  You'll notice upon looking that at the end of that 2nd paragraph on Page 8 there is a "1" at the end of it.  

They tend to put these footnotes at the end of some reports, and on the bottom of the current page on others.

I agree that there are unsolicited opinions throughout and it goes to show the depth of the bias that is ongoing in these investigations.  

The opinions he offers have no bearing, and he absolutely should not be offering his sympathies towards the governor as his sole job in this is to investigate the legal merits of this complaint/clarification.   That alone is his job, and by offering not only sympathy but alternative solutions he is showing that he is deliberately attempting to give Palin an "out" on this matter.  

He has also ignored the fact that the Trust Agreement does not specifically state that these funds are to be used solely and exclusively for legal bills, which just adds to the violation of the ethics laws.

John Coale and Newt Gingrich's ethics advisor (an oxymoron if there ever was one!)set up an illegal fund for Palin, using their "expertise" with federal officials while ignoring Alaska law.

Is the fund limited to paying legal expenses related to ethics complaints, or is it the Palin Family Slush Fund?

Palin is quoted as saying neither she nor her attorney received "one penny" from the fund.

John Coale is quoted as saying that much of Palin's legal debt has been paid.

If so, where did the money come from?  Is one of the 2 lying (a real shocker of a possibility)?

The Personnel Board- assuming it gets to a formal hearing on the matter- should get these and similar questions answered.

According to the funds website, it was created by Kristen Cole and other supporters of the governor who believe the governor should not have to personally pay for legal fees incurred in defending against a series of ethics complaints.

I interviewed Ms.Cole, who confirmed that she and other supporters of the governor came up with the idea of soliciting contributions to pay the governors legal fees.Ms.Cole also stated that she and other supporters set up the Alaska Fund Trust.

A very good take on why Palin resigned, timing is everything and EVERYTHING is converging like an event of great Karma.

I think Palin"s resignation has to do with the 6/30/09 hearing in the Tennessee case of the University of Tennessee student, David C. Kernell, who got into Palin"s personal Yahoo email accounts last fall. The dates fit like an Isatoner glove:

6/29/09 Palin makes 2 tweets sounding mighty cocky about the trial the next day.

6/30/09 the hearing did not go forward as a trial, discovery matters were argued.

7/1/09 in the evening she tells Parnell she is going to resign.

7/2/09 Todd has to leave his fishing to return to Wasilla.

7/3/09 She puts out a notice at 9am that there will be a press conference at 11am.

At press conference she was noticeably shaken and hyperventilating and announces she is resigning effective 7/26/09. That"s an odd day. Why?

7/27/09 is the next hearing in the Tennessee case when the judge will rule on all the emails that she will be required to produce. THE DAY AFTER HER RESIGNATION.

From the 7/17/09 Knoxnews.com: "At a hearing Thursday, U.S. Magistrate Judge Clifford Shirley asked Davies how "recent developments" might have an impact on his request, a reference to Palin's abrupt announcement earlier this month that she was stepping down from the governor's post. "It heightens (the sense of urgency)," Davies responded."

I'm thinn' that this lawyer may be trying to make a name for himself.

My remark about no fees was by NO MEANS any critisizm of the work you and others have done....whatsoever!

I was simply gloating that after all the road blocks put in YOUR path and the MSNBNC , I would find it incredibly amusing for this lawyer to have Palin's administration on notice with a subpoena, to produce what they have been hiding for MONTHS.

At "no cost" as in versus $65,000 for you and millions for MSNBC............for this lawyer to open up this can of worms with a subpoena is "priceless".

IF he is victorious, the actual cost of this will be made public.

The SO CALLED $65,000 and the millions for MSNBC for the same e-mail, or type of e-mail info, actually LESS info..will be brought into the light of day.

All kidding aside, this could bring yet ANOTHER ethics complaint!
